Adtech
Burke began advising advertising agencies on “adtech” in 2017. Most recently, he served as the first Chief Data & Privacy Officer for a European-based global advertising firm, where he oversaw data risks and gained daily working familiarity with the technology and its unique legal obligations.
His advertising industry involvement includes service on the drafting group for the ANA/4As recent “Responsible Privacy in Advertising Initiative.”
In addition to providing industry-savvy privacy and cybersecurity programs and policies, Burke is well-situated to assist legal departments with overflow negotiation and redlining of client or vendor or third-party agreements, DPAs, DUAs, privacy and security riders, BAAs and other data-related advertising agreements.
FinTech & Cryptocurrency
As Deputy Superintendent at the New York State Department of Financial Services (DFS), Patrick Burke founded the Office of Financial Innovation, pioneering regulatory oversight of cryptocurrency and fintech firms under DFS’s Virtual Currency (“BitLicense”) Regulation. He led teams of lawyers, examiners, and analysts conducting in-depth reviews of crypto exchanges, fintech startups, and global banks—driving a 500% increase in BitLicense approvals and establishing frameworks for trading and stablecoin issuance.

eDiscovery and Cross-Border Investigations, Disclosure and US/UK/GDPR Compliance
Burke served as Technology Counsel at one of the earliest eDiscovery processing software companies, co-head of a global eDiscovery practice, and in-house counsel for a U.S.-based eDiscovery search tool provider responsible for Europe, Middle East and Africa, where he was one of the earliest U.S. attorneys with cross-border eDiscovery experience involving European data protection law at scale.
He taught the first eDiscovery course at Cardozo School of Law, and practiced on specialized eDiscovery global legal teams at Reed Smith, Seyfarth Shaw and Norton Rose Fulbright, with a focus on cross-border issues and cybersecurity data reviews.
Burke is adept at managing eDiscovery preservation, forensic collections large and small, testing and negotiating search terms, TAR and AI search technologies, overseeing discovery and privilege review, make privilege calls, overseeing production and coordination with “opposing” receiving or responding counsel, meet-and-confers, as well as court filings, certifications and appearances.
